OVERVIEW Welcome to Beebi Cuddles! The terms "we", "us" and "our" refer to Väikekaru OÜ, operating under the brand name Beebi Cuddles (registration number 17529153, Loitsu 1-138, 13622 Tallinn, Estonia). Beebi Cuddles operates this store and website, including all related information, content, features, tools, products and services (the "Services"). Beebi Cuddles is powered by Shopify.

By visiting or using our Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use our Services.

SECTION 1 – ACCESS AND ACCOUNT By using our Services, you confirm you are of legal age in your country of residence. You are responsible for maintaining the security of your account and all activity under it. You may not transfer or assign your account to another person.

SECTION 2 – OUR PRODUCTS We strive to accurately represent our products. Colors and appearance may vary depending on your device. We do not warrant that product quality will meet your expectations beyond what is required by applicable law. Product descriptions are subject to change at any time.

SECTION 3 – ORDERS Placing an order constitutes an offer to purchase. Väikekaru OÜ reserves the right to accept or decline any order. Your order is confirmed once we send an order confirmation email and payment is processed. Returns and exchanges are governed by our Refund Policy.

SECTION 4 – PRICES AND BILLING All prices are displayed in Euros (EUR) and include VAT where applicable under Estonian and EU law. Prices are subject to change without notice. The price charged will be the price shown at the time of order. Shipping costs are shown separately at checkout.

SECTION 5 – EU CONSUMER RIGHTS If you are an EU consumer, you have the following rights under the EU Consumer Rights Directive (2011/83/EU) and Estonian Consumer Protection Act:

  • 14-day right of withdrawal (cooling-off period): You have the right to withdraw from your purchase within 14 calendar days of receiving your order, without giving any reason. To exercise this right, notify us at info@beebicuddles.ee before the 14-day period expires. After notifying us, you have a further 14 days to return the goods.
  • Exceptions: The right of withdrawal does not apply to personalised/custom-made products, or hygiene products where the packaging has been opened (e.g. underwear, opened textile products).
  • Refunds: We will refund the full product price plus standard delivery costs within 14 days of receiving your withdrawal notice or the returned goods, whichever is earlier. Refunds are made using the same payment method as the original purchase.
  • 2-year statutory guarantee: All products carry a 2-year legal guarantee under EU law. If a product is defective or does not conform to its description, we will repair, replace, or refund it at no cost to you, including return shipping.

SECTION 6 – SHIPPING AND DELIVERY Delivery times are estimates and not guaranteed. We are not liable for delays caused by carriers, customs, or events outside our control. Risk of loss passes to you once the order is handed to the carrier. For full details, see our Shipping Policy.

SECTION 7 – INTELLECTUAL PROPERTY All content on our Services — including trademarks, text, images, graphics, and design — is owned by Väikekaru OÜ or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use our content without prior written consent.

SECTION 8 – THIRD-PARTY LINKS Our Services may contain links to third-party websites. We are not responsible for the content or practices of those sites. Accessing them is at your own risk.

SECTION 9 – RELATIONSHIP WITH SHOPIFY [NOTE: This section should not be removed or modified.] Beebi Cuddles is powered by Shopify. All sales are made directly with Väikekaru OÜ. Shopify is not responsible for any aspect of transactions between you and Väikekaru OÜ. You expressly release Shopify and its affiliates from all claims arising from your purchases.

SECTION 10 – PRIVACY POLICY All personal data is processed in accordance with our Privacy Policy and applicable EU data protection law (GDPR). By using our Services, you acknowledge you have read our Privacy Policy.

SECTION 11 – FEEDBACK By submitting feedback, reviews, or suggestions, you grant Väikekaru OÜ a perpetual, royalty-free licence to use such content for any business purpose. You warrant that your feedback is accurate and does not infringe third-party rights.

SECTION 12 – ERRORS AND OMISSIONS We reserve the right to correct any errors, inaccuracies, or omissions in product descriptions, pricing, or availability at any time, including after an order has been submitted.

SECTION 13 – PROHIBITED USES You may use our Services for lawful purposes only. You may not use our Services to violate any applicable law, infringe intellectual property rights, transmit harmful content, or engage in fraudulent activity.

SECTION 14 – TERMINATION We may terminate your access to our Services at any time without notice if you breach these Terms. Sections on Intellectual Property, Limitation of Liability, Governing Law, and Privacy Policy survive termination.

SECTION 15 – DISCLAIMER OF WARRANTIES Our Services and products are provided "as is" to the extent permitted by applicable law. We do not guarantee uninterrupted or error-free service. Nothing in these Terms limits your statutory rights as an EU consumer.

SECTION 16 – LIMITATION OF LIABILITY To the fullest extent permitted by Estonian and EU law, Väikekaru OÜ shall not be liable for indirect, incidental, or consequential damages. Our liability for direct damages shall not exceed the amount paid for the relevant order. Nothing in these Terms excludes liability for death, personal injury, or fraud.

SECTION 17 – GOVERNING LAW AND DISPUTE RESOLUTION These Terms are governed by the laws of the Republic of Estonia. Any disputes shall be subject to the jurisdiction of Estonian courts.
